These terms and conditions outline the rules and regulations for the use of Arya Pratibha Vikas Sansthan (APVS)'s Website, located at [www.pratibhavikas.org].

The website is owned, developed, run, operated and updated by [Mahasahay Dharampal Arya Media Center situated at 15, Hanuman Road, New Delhi -110001, INDIA] on the behalf of [Akhil Bhartiya Dayanand Sewashram Sangh with registered address at Arya Samaj Rani Bagh, Main Bazar, Rani Bagh , Delhi -110034, INDIA]. By accessing and using this website, you accept and agree to be bound by the terms and provision of this agreement. In addition, when using these particular services, you shall be subject to any posted guidelines or rules applicable to such services. Any participation in this service will constitute acceptance of this agreement. If you do not agree to abide by the above, please do not use this service.

“User”, “Account Holder” , ”Registrant” , “Applicant”, “You” and “Your” refers to you, the person log on this website and compliant to the website's terms and conditions.

“Participant” and “Fellow” refers to the person who is grantedAPVS Fellowship and is compliant to theAPVS's terms and conditions.

“The Promoters”, “Ourselves”, “We”, “Our” and “Us” refers to [Akhil Bhartiya Dayanand Sewashram Sangh with registered address at Arya Samaj Rani Bagh, Main Bazar, Rani Bagh , Delhi -110034, INDIA].

All terms refer to undertake the process of our assistance to the User in the most appropriate manner for the express purpose of meeting the User's needs in respect of joiningAPVS Fellowship program, in accordance with and subject to, prevailing law of INDIA. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.

3. LICENSE

Unless otherwise stated,APVS and/or its promoters own the intellectual property rights for all material on this website. All intellectual property rights are reserved. You may access this from [www.pratibhavikas.org] for your own personal or institutional use subjected to restrictions set in these terms and conditions.

Unless allowed you must not :

Sell, rent or sub-license material from the website.

No account is required to view website for informational purposes.

User may create an account on the website for purposes of filling, editing and submitting Application form forAPVS Fellowship Program.

User shall be of age 18 years or older to create an account on this website.

User is required to provide accurate and valid personal details while creating account otherwise account may be terminated whenever anomaly is detected.

By creating account User is giving his consent for receiving promotional material sent by The Promoters through various means including SMS and Email.

7. TERMINATION OF ACCOUNT

Any account may be terminated for the following reasons :

  • (a) Furnishing bogus and fraudulent details for account creation and Application Form.
  • (b) Furnishing details of any other person without his consent.
  • (c) Furnishing details of any minor (below age of 18 years).
  • (d) If found guilty of any misconduct or abuse of service of this website orAPVS.
  • (e) Any other undisclosed reason.

8. APPLICATION FORM

Online Application Form facility is provided to let User fill and submit their candidature for joiningAPVS Fellowship at our website/APVS.

User can view, fill and edit any data in Application Form before finally submitting the online application form. NO CHANGE WILL BE ALLOWED AFTER APPLICATION FORM IS FINALLY SUBMITTED.

Applications are subject to rejection in case of occurrence of unprecedented event or situations out of control of The Promoters.

All Data filled in Application Forms is property ofAPVS andAPVS may use this data as per stated in Privacy Policy.

All Application Forms will be scrutinized by selectors as per criteria set by the Promoters and are liable to be rejected without disclosing any reason.

9. PAYMENT & REFUND POLICY

No payments are accepted byAPVS from Applicants or Fellows at any stage.

10. MDAVPS FELLOWSHIP

a. Eligibility: To be eligible to apply for the Fellowship and receive the Fellowship award, Applicant must

  • (a) Be 20 years and older,
  • (b) Have the eligibility for appearing for the UPSC Civil Services Examinations 2020 or 2021 and onwards academic years,
  • (c) Will be commencing or completed studies, at an academic institution recognized by Ministry of Human Resource Development, Government of India.

APVS reserves the right to require Candidates to prove that they are eligible in accordance with these Terms and Conditions; and award the Fellowship to another Candidate and to require the return of any Fellowship monies already awarded to such disqualified Candidate.

b. Application process: To enter the Fellowship Program Candidates must submit the Application Form online onAPVS website www.pratibhavikas.org.

The Fellowship may only be entered once, and multiple applications will not increase your chances to be awarded the Fellowship.APVS will only consider the last application submitted by a Candidate and all previous applications will be rejected.

APVS reserves the right to request additional information from Candidates related to their Fellowship application.

c. Notification of Shortlisted Candidates: Shortlist Candidates to receive the Fellowship will be notified no later than 15 days following the Final Date of application at the email address they provided when they applied for aAPVS Fellowship. Candidates who were not shortlisted to receive a Fellowship will not be notified.

If a Shortlist Candidate does not respond within the time frame and/or provides the documents requested byAPVS or if the Candidate cannot be contacted (for example, a notification email is returned as undeliverable), such Candidate will forfeit their candidature to participate in the Fellowship Program and to receive the Fellowship;APVS shall have no liability to such Candidate whatsoever, andAPVS reserves the right to select an alternative Recipient for the Fellowship.

d. Notification of the Fellowship Recipient: The Candidate who is chosen as the final recipient shall be notified no later than 15 days following the Selection Date by the email address or phone number they provided in their Fellowship application. A Candidate who has been notified in this way will only be eligible to receive a Fellowship, if they confirm in writing that they accept these Terms and Conditions and provide any other documents or information thatAPVS may reasonably require to establish the Candidate's eligibility, all within 15 days of receiving the notification email. Following receipt byAPVS of these documents and subsequent confirmation byAPVS of the Candidate's eligibility, the Candidate will be the "Recipient" for the purposes of these Terms and Conditions.

If the Candidate does not respond within this time frame and/or provides the documents requested byAPVS or if the Candidate cannot be contacted (for example, a notification email is returned as undeliverable), such Candidate will forfeit all rights to the Fellowship,APVS shall have no liability to the Candidate whatsoever, andAPVS reserves the right to select an alternative Recipient for the Fellowship.

e. Awarding of the Fellowship: The Recipient of the Fellowship will be offered the opportunity to receive an accommodation, meals, coaching fee payment on their behalf to fund one year of their studies at an eligible academic institution, for an eligible course of study. The payment amount shall be determined by the tuition cost for one year of the eligible course, and shall be paid by cheque that the tuition is due for the academic institution, up to the maximum of Rs. 2,00,000.APVS will make a payment to the academic institution which the Recipient will be attending, to settle the tuition fees for the academic year on behalf of the student and which will be allocated to the Recipient’s tuition account. The payment date shall be determined based on the tuition due date for the course in which the Recipient is enrolled at their academic institution, but shall be no later than 31 December, 2019.

f. General conditions regarding the Fellowship Program: The Fellowship is as stated and is non-exchangeable, cannot be substituted and is non-transferable. There is no cash or other alternative to the Fellowship in whole or in part, unless otherwise provided inAPVS’s sole and unfettered discretion. By participating in the Fellowship, Candidates agree that the Fellowship is awarded on an "as is" basis, and that neitherAPVS nor any of its subsidiary or affiliated organizations, make any representations or warranties of any nature with respect to the Fellowship. In addition, Candidate agrees to cooperate fully withAPVS or its designated representatives in conjunction with the reporting of receipt of the Fellowship to all appropriate governmental authorities as per applicable law.

g. Right to cancel, modify or disqualify: In the event that, for reasons beyondAPVS’s reasonable control and not related to the Recipient,APVS is unable to award the Fellowship as described in these Terms and Conditions,APVS reserves the right to modify, cancel, terminate or suspend the Fellowship Program in whole or in part, at its sole discretion, if it believes the Fellowship Program is not capable of being conducted as specified within these Terms and Conditions or any other cause that is beyond the reasonable control ofAPVS that could corrupt or affect the administration, security, impartiality or normal course of the Fellowship Program. In such event,APVS shall use its reasonable efforts to make the Fellowship available in a manner that is fair, appropriate and consistent with these Terms and Conditions as determined byAPVS in its sole discretion.

Any Candidate who acts with regard to the Fellowship Program in a manner, which inAPVS's reasonable determination is contrary to these Terms and Conditions or by its nature is unjust to other Candidates (including without limitation tampering with the operation of the Fellowship Program, providing false or misleading information when applying for the Fellowship, cheating, hacking, deception or any other unfair playing practices such as intending to annoy, abuse, threaten or harass any other Candidates ofAPVS and/or any of its member or representatives, may be rejected and excluded from the Fellowship Program atAPVS's sole discretion.

h. Publicity: By accepting the Fellowship, the Recipient accepts that their name, photographs, voice, image, video, likeness, address (city/state) may be featured in publicity materials relating to the Fellowship Program ofAPVS generally, except where prohibited by law. This includes publishing the name, photograph and video of the Recipient onAPVS’s website (pratibhavikas.org) if they are confirmed as a Recipient.

The name and address of the Recipient of the Fellowship will also be made available to Candidates and the public on request by sending an email to dss.pratibha@gmail.com

i. Applicable law: The Fellowship Program and these Terms and Conditions shall be governed by and construed in accordance with Indian law (Constitution of India), and the court of Delhi will have exclusive jurisdiction in relation to any disputes. Where applicable, to the fullest extent permitted by law, any such dispute must be brought individually (NOT as part of a class action), with recovery being limited to one’s actual costs in conjunction with participation in the Fellowship Program (if any) with all damages or other forms of recovery being expressly waived.

11. RESERVATION OF RIGHTS

The Promoters reserve right to terminate any account on this website without disclosing any reasons.

The Promoters reserve right to cancel any Application Form submitted on this website without disclosing any reasons.

The Promoters reserve right to deny Fellowship against any Application Form submitted on this website without disclosing any reasons.

The Promoters reserve right to discontinue Fellowship Program at any time without disclosing any reasons.

The Promoters reserve right to fully revoke or modify any service or facility or program listed on this website without prior intimation.

The Promoters reserve right to deny admission to any individual or group of individuals in theAPVS hostel compound without disclosing any reasons.

The Promoters reserve right to expel any individual or group of individuals entered in theAPVS hostel compound without disclosing any reasons.

The Promoters reserve right to deny access to any area ofAPVS compound to any individual or group of individuals entered in theAPVS hostel compound without disclosing any reasons.

12. PRIVACY POLICY

13. LIABILITY

Website : The Promoters disclaim any liability for any loss or inconvenience suffered by User due to using this website.

Fellowship :APVS being a Non Profit Organisation promoted by The Promoters without any profit making or commercial intentions. All the facilities, programs and services are being provided for facilitatingAPVS Fellows to succeed in their respective exams.

AllAPVS's decisions in relation to the Fellowship Program are final and binding in all respects and are not subject to appeal.APVS will not enter into any correspondence with Candidates in respect of this Fellowship Program (other than those who have been selected to proceed to the final round).APVS’s failure to enforce any provision of these Terms and Conditions in a given instance shall not constitute the waiver of such provision. The provision of the Fellowship does not imply endorsement byAPVS of any academic institution nor any other third parties concerned in any way with the Fellowship.

The Promoters disclaim any liability for any loss, injury or death of any participant before, during or after theAPVS.
